Societas - a régmúlt emléke vagy a mai napig nyomot hagyó "gazdasági modell"?
A család mint a gazdasági társulások mintaképe a római jog és az amerikai esetjog tükrében

A tanulmány középpontjában a család keretében kibontakozó közösségi értékek gazdasági viszonylatban való továbbélése áll, melynek római jogi megnyilvánulása eleinte a consortium ercto non cito majd, a societas intézményében tükröződött vissza legteljesebb mértékben (cf. Gaius 3,154 A). Ennek alátámasztására bemutatásra kerül a societas személyegyesítő jellegének fontossága, kiemelve a jogintézmény azon alapelveit mint a nyereségben és veszteségben való osztozás, a societas leonina tilalma, illetőleg az érdekközösség és az együttműködés kiemelt fontossága, melyek továbbélése bemutatásra kerül az európai jogi gondolkodástól idegennek tekintett amerikai esetjogban egyaránt. Végezetül következtetések kerülnek levonásra a bizalom, a kölcsönös együttműködés, a kockázatvállalás foka, a fenntarthatóság és az emberi kapcsolatrendszer minőségi kibontakozását tekintve.

Societas - the Long-Forgotten Institution or Still a Role Model for Business Associations?
The Family as the Role Model for Business Associations in the Aspect of Roman Law and the American Common Law

The study intends to give an overview of the essence of those values in family relations, which are regarded to be reflected not just in the legal framework of the consortium ercto non cito and the societas, both originating from Roman law, but also in today's business relations. To show how these values are manifested and continue to live on centuries after their initial appearance, a comparative analysis will be drawn on the basis of those essential principles of societas, such as the prohibition of societas leonina, the community of interest in the profit and loss and the importance of common objectives and interests, which will be shown to play a key role behind the legal reasoning of American case law as well. As a conclusion, broader implications will be made with regards to the crucial importance of trust, collaboration and sustainability in human relations in the aspect of business associations.
