Jogszerű ellenőrzés vagy rejtett adóharmonizáció? - Régi vita, új fejlemények az uniós állami támogatási jog legfrissebb esetjoga alapján

Az Európai Unió közös piacként való megalapítása óta a belső határok és kereskedelmi akadályok nélküli egységes piac előmozdítására törekszik. Az uniós jog fejlődésének jelenlegi szakaszában a közvetlen adók ugyan tagállami hatáskörben vannak, de a tagállamok e hatáskörüket csak az uniós jog tiszteletben tartásával gyakorolhatják. Az Európai Bizottság kizárólagos hatáskörébe tartozik, hogy ellenőrizze az EUMSZ (állami támogatásokról szóló) 107. cikkének érvényre juttatását. A Bizottság úgy véli, ennek keretében joga van adóintézkedéseket is állami támogatásnak minősíteni. A tagállamok azonban ezzel gyakran nem értenek egyet, szerintük ugyanis a szubszidiaritás elve alapján a Bizottság hatásköre nem terjedhet ki a közvetlen adók vizsgálatára, és a Bizottság új megközelítésével valójában rejtett adóharmonizációra törekszik.
Ebben a tanulmányban arra a kérdésre kerestük a választ, hogy meddig terjed a Bizottság ellenőrzési jogosultsága a tagállami adóintézkedések kapcsán. A kérdés megválaszolásához a Bizottság, illetve az Unió Bíróságának legfrissebb esetjogát vizsgáltuk.

Legitimate Control or Covert Tax Harmonization? - Old Debate, new Directions Based on the latest Case Law in EU State Aid Law

The European Union, since its establishment as a common market, has sought to promote a single market without internal frontiers and barriers to trade. At the current stage of development of EU law, although direct taxation is a Member State competence, Member States should exercise that competence in compliance with the law of the European Union. The European Commission has exclusive power to monitor Member States' compliance with Article 107 the TFEU (on prohibition of State aid). In this context, the Commission considers itself to be entitled to classify tax measures as State aid. However, the Member States often disagree with this, as they consider that, in accordance with the principle of subsidiarity, the Commission's competence should not extend to the examination of direct taxes and the Commission's new approach constitutes in fact a disguised tax harmonization.
In this study, we examine the extent of the Commission's power of scrutiny over Member States' tax measures. In doing so, we have analysed the most recent case law of the European Commission and the Court of Justice of the European Union.
