Az Európai Unió irányelv-javaslata a formatervezési minták oltalmáról

Az Európai Bizottság 2022. november 28. napján tette közzé designreform-csomagját, amely egy rendelet- és egy irányelvjavaslatot tartalmaz. Jelen tanulmány célja, hogy a nyilvánosan hozzáférhető szövegverzió alapján bemutassa az irányelvi javaslathoz vezető utat, a bizottsági célkitűzéseket, a jogalkotási munka alapját képező normaszöveg legfontosabb rendelkezéseit - ezek között kiemelt figyelmet fordítva az érdemi vizsgálat szűkítésének és javítási pótalkatrészek kérdésének -, illetve ezeknek a hazai jogszabályi környezetre gyakorolt, várható hatását.

The European Union’s directive proposal on the protection of industrial designs

On 28 November 2022, the European Commission published its design reform package, which includes a proposal for a regulation and a directive. The aim of this paper is to present the path leading to the directive proposal, the Commission's objectives, the key provisions of the text on which the legislative work is based, with particular attention to the issues of narrowing the scope of substantive examination and the issue of the repair clause, and their expected impact on the Hungarian legislative environment.
