A tanulmány fogyasztóvédelmi hatósági eljárás kapcsán - polgári jogi (pl. kellékszavatossági, jótállási) vonatkozásokat is tárgyalva, 2020-2021. évi jogszabályváltozásokra is utalva, a bírósági gyakorlatra is tekintettel - azzal foglalkozik, hogy az általános közigazgatási rendtartásról szóló 2016. évi CL. törvény szerinti ügyfélfogalom kiterjed-e, illetve mennyiben, mikor terjed ki a fogyasztóvédelemről szóló 1997. évi CLV. törvény szerinti fogyasztóra. A kérdések helyes megválaszolása a fogyasztói (alap)jogok, a fogyasztók jogainak hatékony védelme szempontjából sem érdektelen (lásd pl. döntés közlése, jogorvoslathoz való jog), az ügyféli státusz jogellenes megtagadása pedig a tisztességes eljáráshoz való alapjogot is sérti.

The study, while also discussing civil law (e.g., warranty, guarantee) aspects in connection with procedures of the consumer protection authority and pointing to the changes in the legislation occurred in 2020-2021 and taking into account the court practice, analyses whether and, if yes, to what extent the concept of client under Act CL of 2016 on general rules of administrative procedure covers the concept of consumer under Act CLV of 1997 on consumer protection. The correct answer to the questions is also of relevance from the point of view of consumer (fundamental) rights and the effective protection of consumer rights (see e.g., notification of a decision, the right to legal redress), whereas the unlawful denial of client status violates the fundamental right to a fair trial.
