A terhelt vallomásának szerepe a büntetőeljárásban

A büntetőeljárás teljes szakaszában kiemelt jelentőséggel bír a terhelt vallomása attól függően, hogy az eljárás mely szakaszában tart a büntetőeljárás. A nyomozás kezdetén a nyomozó hatóság nyomozási cselekményei főként olyan bizonyítási eszközök beszerzésére irányulnak, amelyek szükségesek a megalapozott gyanú közléséhez. A megalapozott gyanú közlését követően a terhelt vallomásának tartalmától függően felmerülhetnek olyan szükségesen végrehajtandó nyomozási cselekmények is, amelyek a gyanúsított védekezésének ellenőrzésére irányulnak, ezért alapjaiban határozhatja meg a nyomozás további irányát és szerepet játszik abban is, hogy a nyomozás vádemelési javaslattal zárul-e. Egy érdemi védekezést tartalmazó terhelti vallomás hatással lehet arra is, hogy az ügyész vádat emel-e, megszünteti az eljárást vagy más ügyészi intézkedéssel zárul le a büntetőeljárás. A vádemelést követően pedig a vádlotti vallomás lényegében a teljes bírósági eljárást meghatározza, legyen szó a bizonyítási eljárásról, annak menetéről vagy a büntetés kiszabási szempontokról egyaránt. A büntetőeljárás során a büntetőeljárás tárgyát képező bűncselekmény tükrében ezért fontos vizsgálni a terhelt személyiségét, a bűncselekmény elkövetésének ideje előtti, az alatti és azt követő fizikai és mentális állapotát. Lényegében a terheltnek egy érdemi védekezést tartalmazó vallomását vagy adott esetben egy ténybeli és bűnösségre kiterjedő beismerő vallomását nevezhetjük a büntetőeljárás origójának, illetve a bizonyítási eljárás kiindulási pontjának. A büntetőeljárások döntő többségében az ártatlanság vélelmének érvényesüléshez elengedhetetlenül szükséges az, hogy a terhelt érdemi védekezést terjesszen elő. A tanulmány a büntetőeljárás során a terhelt vallomásának jelentőségét és annak lehetséges befolyásoló tényezőit vizsgálja.

Role of Suspect's Testimony in the Criminal Procedure

Testimony of the suspect is relevant in the whole criminal procedure, depending on the stage of the proceedings. The aim of investigative actions of the investigative authority, at the beginning of a criminal investigation, is to obtain the key evidence to announce the strong suspicion. Depending on the accused's testimony, after the announcement of the strong suspicion, there may be investigative measures that are aimed at checking the suspect's defense. Due to the above the suspect's testimony can fundamentally determine the further direction of the investigation and also plays a role in whether the investigation ends with an accusation. Testimony of the accused person containing a substantial defense can also affect whether the prosecutor files charges, terminates the proceedings or closes the criminal procedure with other prosecutorial measures. After the charges, the defendant's confession essentially determines the entire court procedure, whether it is about the evidentiary procedure, its course or the sentencing aspects. During the criminal proceedings, in light of the crime that is the subject of the criminal proceedings, it is important to examine the personality of the accused person, his physical and mental state before, during and after the crime was committed. In essence, the defendant's statement containing a substantive defense or, in appropriate cases, a factual and guilt-related confession can be called the origin of the criminal procedure or the starting point of the evidentiary procedure. In the vast majority of criminal proceedings, for the presumption of innocence to prevail, it is absolutely necessary for the accused to present a substantive defense. This paper examines the impotance and affecting factors of the defendant's testimony during criminal proceedings.
