Az Európai Unió szociális jogalkotásában kiemelt jelentőséget élvez a munkavédelem. A szabályozás gerincét a munkavédelmi keretirányelv (89/391/EGK) jelenti, amelyet 1992. december 31-ig kellett átültetnie a tagállamoknak. A tanulmány célja, hogy bemutassa az immár 30 éve hatályos keretirányelv legfontosabb intézményeit, gyakorlatát, és felvázolja a felülvizsgálatával kapcsolatos elképzeléseket. Ehhez áttekintem az uniós munkavédelmi jog fejlődésének folyamatát, a keretirányelvre és az ún. egyedi irányelvekre épülő hatályos rendszert és a keretirányelv legfontosabb intézményeit. Végül, az Európai Bizottság elemzései és az Európai Unió munkavédelmi stratégiája alapján összefoglalom, milyen elképzelések láttak napvilágot a szabályozás felülvizsgálata kapcsán. Az elemzés során látható lesz, hogy keretirányelv általános szabályaival, tágan értelmezhető fogalmaival alkalmasnak bizonyult arra, hogy az emberi munkaerő hasznosításának munkavédelmi kereteit tartósan rendezze.

30 Years from the come into Effect of the Occupational Health and Safety Framework Directive

In the social legislation of the European Union, occupational health and safety is of particular importance. The backbone of the regulation is the occupational health and safety framework directive (89/391/EEC), which was to be implemented by December 31 1992. The purpose of the paper is to present the most important institutions and practices of the framework directive, which has been in force for 30 years, and to outline the ideas related to its revision. For this purpose, I review the process of the development of EU occupational health and safety law and the present system of the framework directive and the so-called individual directives. Based on the European Commission's analyses and the European Union's occupational health and safety strategy, I will summarise what ideas have come to light regarding the revision of the directive. In the course of the analysis, it will be seen that the framework directive, with its general rules and broadly interpretable concepts, proved to be suitable for permanently regulating the health and safety aspects of the utilisation of human labour.
