Brüsszel IIb rendelet: a gyermek érdekének elsődlegességének érvényesülése - különös figyelemmel a meghallgatásra

Bár az anyagi jog nem képezi az uniós harmonizáció területét, a joghatóságra, elismerésre, végrehajtásra vonatkozó uniós szabályozás családjogi területen hatással van az alapvető jogokra. Így a gyermek érdekének elsődlegessége, mint alapvető jog, akkor tud érvényre jutni, ha a kollíziós szabályok is ezt segítik elő. Milyen előrelépést jelent az új rendelet ebben a tekintetben a korábbi szabályokhoz képest? Hogyan hat ez a gyermek alapvető jogaira?
A best interest of the child az ENSZ Gyermek Jogairól szóló Egyezményének 3. cikke - magyarra szerencsétlenül "a gyermek mindenek felett álló érdeke"-ként fordított - mint alapelv, hatja át még explicitebben az új rendeletet. Mindenek felett ugyan nem áll a gyermek érdeke, de az elv tükrözi azt a törekvést, hogy mindig az adott körülmények között a lehető legjobban juttassák érvényre a gyermek érdekét.

Brussels IIb Regulation: Best Interests of the Child - with Special Reference to the Hearing

Although substantive law is not the subject of EU harmonisation, EU rules on jurisdiction, recognition and enforcement in the area of family law have an impact on fundamental rights. Thus, the best interest of the child as a fundamental right can only be enforced if the conflict-of-law rules promote it. What improvement does the new Regulation bring in this respect compared to the previous rules? How does it affect the fundamental rights of the child?
The principle of the best interest of the child - Article 3 of the UN Convention on the Rights of the Child - mistranslated into Hungarian as the overriding interest of the child, permeates the new Regulation even more explicitly. While the best interest of the child is not overriding all, the principle reflects the concern to ensure that the best interest of the child is always given priority in the circumstances.
