A Facebook Oversight Board nyolc kiemelt kérdése és lehetséges megoldásai

Jelen tanulmány célja a Facebook Oversight Board bemutatása kritikai szemszögből különös tekintettel az Oversight Board funkcióira, hatáskörére, és mechanizmusaira. A tanulmány struktúrája a bevezető és konkludáló szegmensek mellett három kiemelt témakörre építkezik: (1) a Facebook Oversight Board bemutatására, (2) az Oversight Board nyolc olyan polemikus kérdéskörére, amelyek megnehezítik, hátráltatják, illetve aggályokat vetnek fel a Facebook "magánbíróságának" működése kapcsán, és (3) egy alternatív megoldási javaslatra, nevezetesen a Facebook Oversight Board megszüntetésére. Az (1) témakör alatt betekintést nyújtok az Oversight Board kialakulása és működési szabályzatai kapcsán. E helyütt különös figyelmet szánok az emberi jogi bíróságok az Oversight Board közötti szerkezeti és jogi hasonlóságok, illetve különbségek ismertetésére. A (2) témakör tekintetében nyolc problémát vetek fel az Oversight Board vonzatában. A tanulmány célja e témakör alapos körbejárásával és a problémák beható ismertetésével kettős. Egyfelől alá kívánom húzni azokat a jogilag vagy hatékonyság szempontjából kényes aspektusokat, amelyek az Oversight Board funkcionálást megnehezítik. Másfelől egy proaktív kritikai attitűdöt proponálok azzal, hogy a problémák és kérdések felvetésén túl, a nevezett aggályok tekintetében megoldási javaslatokat is kínál az egyes alfejezetek végén. Ehhez kapcsolódóan hangsúlyozom ki a (3) témakört is, amely az Oversight Board megszüntetétésének témáját és lehetséges következményeinek taglalását proponálja. A tanulmány célja a fentiek fényében az Oversight Boarddal kapcsolatos tudományos diskurzus bővítése egy új, kritikai perspektívából.

The critique of Facebook's "elite court"
Facebook's Oversight Board's eight critical questions and the possible solutions

The purpose of this paper is to provide a critical perspective on the Facebook Oversight Board, with a particular focus on the functions, powers, and mechanisms thereof. The structure of the paper is based on three main themes, in addition to the introductory and concluding segments: (1) an introduction to the Facebook Oversight Board, (2) eight polemical issues of the Oversight Board that complicate, impede, or raise concerns about the functioning of Facebook's "private court," and (3) an alternative proposal for a solution, namely the abolition of the Facebook Oversight Board. Under segment (1), I provide insights into the formation and operating rules of the Oversight Board. In this segment particular attention is paid to the structural and legal similarities and differences between the human rights courts and the Oversight Board. With regard to segment (2), eight issues are raised in the context of the Oversight Board. By providing a thorough overview of this topic and a detailed description of the problems, the scope of the paper is twofold. On the one hand, I wish to underline the legal and efficiency-related aspects which make the functioning of the Oversight Board difficult. On the other hand, I intend to exercise a proactive critical stance by offering, in addition to raising problems and issues, suggestions for solutions to the concerns raised at the end of each sub-chapter. Related to this, segment (3) is also emphasised, which proposes to address the issue of the abolition of the Oversight Board and its possible consequences. In the light of the above, the aim of this paper is to broaden the academic discourse on the Oversight Board from a new critical perspective.
