A diplomaták beutazásának jogszabályi feltételei Magyarországon

Európai Unió Tanácsa 2022. február 25-én határozatot hozott az Európai Unió és az Orosz Föderáció között köttetett, a rövid idejű tartózkodásra jogosító vízumok kiadásának megkönnyítéséről szóló megállapodás alkalmazásának részleges felfüggesztéséről. Ennek eredményeként az orosz diplomaták a 2022. február 28-tól nem élveznek vízummentességet az EU-ban. A döntés sajátos jogi helyzetet teremtett Magyarországon, mivel az orosz és a magyar diplomaták vízummentességét bilaterális megállapodások is rögzítik. A tanulmány ennek kapcsán áttekinti a diplomata, illetve szolgálati útlevelet birtokló személyek magyarországi beutazásának jogszabályi kereteit, külön hangsúlyozva a nemzetbiztonsági szempontokat, figyelemmel az Ukrajna elleni orosz agresszió miatt kialakult helyzetre.

The legal requirements of diplomats for entry to Hungary
With particular attention to the situation due to the Russian - Ukrainian conflict

On 25th February 2022 the Council of the European Union made a Decision on the partial suspension of the application of the Agreement between the European Community and the Russian Federation on the facilitation of the issuance of visas to the citizens of the European Union and the Russian Federation. As a result of this from 28th February 2022 Russian diplomats no longer enjoyed visa-free entry to the EU. This Decision created a controverse legal situation in Hungary because the visa-free travel of Russian and Hungarian diplomats between the two countries is regulated in bilateral agreements as well. This study reviews the legal requirements to enter and stay in Hungary for holders of diplomatic and service passports emphasizing the national security aspects in light of the situation due to the Russian aggression against Ukraine.
